Although Proposition 8 was officially scrapped on Friday, attorneys sponsoring California’s ban on same-sex marriage aren’t giving up.
The LBGT community has been celebrating a great victory for civil rights this weekend. Proposition 8 officially ended on Friday, when the 9th Circuit Court of Appeals lifted the ban on gay marriage in California.
After the announcement, same-sex couples began lining up on the steps of San Francisco’s City Hall eager to apply for marriage licenses. But advocates of the gay marriage ban are demanding that the U.S. Supreme Court pause the wedding bells.
Attorneys sponsoring the Alliance Defending Freedom are claiming that because the ban was lifted while a lawsuit challenging it was going through the courts, same-sex weddings resumed prematurely. They argue that their clients still have 22 days to ask justices to reconsider their decision.
This past Wednesday, the Supreme Court gave the go-ahead for the lift when the Defense of Marriage Act – which would have prevented the federal government from recognizing same-sex marriages legalized by states – was deemed unconstitutional by a ruling of 5-4.
It seems as though this will be a tough battle for the ADF to win.
